Procedure to deal with Complaints
In the receipt of a valid DMCA notice, we shall do the following:
- Assessment: We shall go through the given information and confirm whether the given materials actually infringe the copyright laws.
- Removal: In the case where the content is infringement to copyright then we will remove or disable access to the material to our site.
- Notice: Once the material is removed or access to the material is disabled, we will send a notification to the original poster of the material, letting them know that the material has been removed and giving them the contact information to the complaining party in case they would like to pursue further action.
- Counter Notice: In case the original poster thinks that the content does not violate any copyright, he/she may forward a counter notice to us which would contain the following details.
Counter Notification
You may file a counter notice with us if you think: the material taken down or disabled was not used in an infringing way; or you have the authorization to replace the material. In order to submit a counter notice, you should state the following:
- Identification: Your full legal name, address and telephone number.
- Content Identification:** Name the material that is blocked or taken away.
- Good Faith Statement: Submit a statement under the penalty of perjury that you believe that you have a good faith belief that the material was removed or disabled due to mistake or misidentification of the material.
- Contact Information:** Provide a statement that you agree to the jurisdiction of the Federal District Court within the judicial district in which your address is located (or, if your address is outside of the United States, for the Southern District of New York), and that you will accept service of process by the person who has submitted the original claim.
- Signature: Sign in person or give an electronic signature.
The counter notice should be sent to the above mentioned email address.
